1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you and Local Website Pro ("Company," "we," "us," or "our"), concerning your access to and use of the localwebsitepro.com website as well as any other media form, channel, or service related thereto.
You agree that by accessing the Site and/or Services, you have read, understood, and agree to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Services Description
Local Website Pro provides the following services:
- Custom Website Development: Hand-coded websites using Next.js, React, and modern web technologies
- Managed Hosting: Edge network hosting and maintenance services
- Missed Call Text Back: Automated SMS response system for missed business calls
- Review Automation: Automated review request and management systems
- Growth Hunter: OSINT-based lead generation services
- CRM Integration: GoHighLevel and other CRM platform integrations
3. Code Ownership & Intellectual Property
Client-Owned Code
Upon full payment of the agreed project fee, the Client shall own 100% of the custom website code developed specifically for them. This includes all HTML, CSS, JavaScript, and React components created for the project. The Client will receive access to a GitHub repository containing the source code.
Company-Retained IP
Local Website Pro retains ownership of:
- Proprietary frameworks, boilerplates, and starter templates
- Internal tools and automation systems
- Third-party integrations and API connectors
- The "Local Website Pro" brand, logo, and marketing materials
Third-Party Licenses
Websites may include open-source software subject to their respective licenses (MIT, Apache 2.0, etc.). The Client agrees to comply with all such third-party license terms.
Permitted Use
The code you receive is licensed for use as a website for your business or your clients. You MAY:
- Use the code for your own business website
- White-label the website and sell it to your clients as your own work
- Resell websites to end-clients (agency model)
- Modify the code for your specific needs
- Host the website on any platform or provider of your choice
PROHIBITED USE - STRICTLY ENFORCED
The code you receive is NOT licensed for the following uses. Violation of these terms will result in immediate legal action:
- SaaS Platforms: You may NOT use this code to create a software-as-a-service platform, website builder, or any automated website generation service that competes with Local Website Pro
- Process Duplication: You may NOT reverse-engineer, analyze, or replicate our proprietary website generation process, AI orchestration systems, design DNA algorithms, or automation workflows
- Mass Distribution: You may NOT distribute, sublicense, or make the code available to third parties for the purpose of creating competing services
- Code Repositories: You may NOT publish this code to public repositories, code-sharing platforms, or make it freely available online
Enforcement & Remedies
We actively monitor for unauthorized use of our intellectual property. If you are found in violation of these terms:
- Your license to use the code will be immediately and permanently revoked
- We will pursue injunctive relief to stop the infringing activity
- We will seek monetary damages including actual damages, lost profits, and disgorgement of your profits from the infringing use
- We reserve the right to pursue statutory damages and attorney's fees where applicable under copyright law
This license restriction applies regardless of how many modifications you make to the code. The underlying concepts, architecture, and design patterns remain our intellectual property.
4. Payment Terms
One-Time Development Fees
- 50% deposit required to commence work
- 50% balance due upon project completion, before code handoff
- All fees are non-refundable once work has commenced
Monthly Subscription Fees
- Billed monthly in advance
- First payment due upon service activation
- Automatic renewal unless cancelled with 30 days notice
- No refunds for partial months
Late Payments
Invoices not paid within 30 days may result in service suspension. A 1.5% monthly late fee may be applied to overdue balances.
5. Refund Policy
IMPORTANT: ALL DIGITAL PRODUCT SALES ARE FINAL
Due to the nature of digital products and instant code delivery, all sales of exported website code are final and non-refundable. By completing your purchase, you acknowledge and agree to this policy.
Code Export Products (No Refunds)
The following products are NON-REFUNDABLE under any circumstances once the transaction is complete:
- Basic Buyout ($99): Full website source code delivered to your GitHub repository
- Full Export ($299): Website code plus AI agent configuration and chat widget
- Generation Packs: All credit packs (Single, Boost, Scale) are non-refundable digital goods
- SEO City Packs: Generated city pages are delivered instantly and cannot be refunded
Reason: Once code is delivered to your GitHub repository, it cannot be "returned" or "undelivered." You receive immediate, permanent access to the source code upon purchase. This is equivalent to purchasing and downloading software - the transaction is complete upon delivery.
Subscription Services
14-DAY SATISFACTION GUARANTEE
All monthly subscription plans (Starter, Pro, Agency) include a 14-day money-back guarantee. If you're not satisfied within the first 14 days of your subscription, contact us for a full refund of your first month's payment.
- Within 14 Days: Full refund of your subscription payment upon request. No questions asked.
- After 14 Days: No refunds for the current billing period. You may cancel at any time and retain access until the end of your paid period.
- AI Workforce Add-ons: No refunds for used minutes, messages, or tokens. Unused credits do not roll over.
- OSINT/Security Services: No refunds once scanning has begun, as resources are immediately consumed.
Note: The 14-day guarantee applies only to monthly subscription plans, not to one-time purchases like code exports, generation packs, or city packs.
Chargebacks & Disputes
If you initiate a chargeback or payment dispute after receiving digital products (code delivery), we reserve the right to:
- Immediately terminate your account and all associated services
- Revoke access to any managed hosting or active subscriptions
- Report the dispute to fraud prevention services
- Pursue collection of the disputed amount plus associated fees

Exceptions
Refunds may be considered only in the following limited circumstances, at our sole discretion:
- Duplicate charges due to technical error (we will refund the duplicate)
- Service was never delivered due to our technical failure (with documented evidence)
- Required by applicable law in your jurisdiction
By completing any purchase on LocalWebsitePro, you acknowledge that you have read, understood, and agree to this Refund Policy. If you do not agree with these terms, do not complete your purchase.
6. Service Level Agreements
Managed Hosting (The Engine / Total Command)
- 99.9% uptime guarantee (excluding scheduled maintenance)
- Response time: 24 hours for standard issues, 4 hours for critical outages
- Monthly hosting credit for SLA breaches
Development Services
- Typical project timeline: 2-4 weeks (varies by scope)
- Up to 2 rounds of revisions included
- Additional revisions billed at $150/hour
Performance Metrics Disclaimer
Performance scores referenced on our website (such as Google Lighthouse, PageSpeed Insights, Core Web Vitals) are targets based on our standard configurations, not guarantees. Actual scores may vary due to:
- Testing conditions: Lighthouse scores can fluctuate between tests due to server load, network conditions, and Google's testing infrastructure
- Third-party scripts: Any analytics, chat widgets, ads, or tracking scripts you add may impact performance
- Content changes: Large images, videos, or heavy content you add may affect load times
- Algorithm updates: Google periodically updates how Lighthouse scores are calculated
- Geographic location: Test results may vary based on the testing location
We build every site using performance best practices and optimize for the highest possible scores. However, we cannot guarantee specific benchmark numbers as these metrics are controlled by third parties and subject to change. Our commitment is to deliver sites that are significantly faster than traditional page builders like WordPress, Wix, or Squarespace.
7. Client Responsibilities
The Client agrees to:
- Provide all necessary content, images, and materials in a timely manner
- Respond to communications within 5 business days
- Ensure all provided content does not infringe on third-party rights
- Maintain accurate contact and billing information
- Comply with all applicable laws regarding their business operations
- Not use services for illegal, fraudulent, or harmful purposes
8. Prohibited Activities & Security
⚠️ WARNING: UNAUTHORIZED ACCESS IS A FEDERAL CRIME
We do NOT operate a bug bounty or vulnerability reward program. Unauthorized access, testing, scanning, or probing of our systems is strictly prohibited and constitutes a violation of:
- Computer Fraud and Abuse Act (18 U.S.C. § 1030) - Federal criminal law with penalties up to 20 years imprisonment
- State computer crime laws - Additional state-level criminal and civil liability
- Cyberstalking laws (18 U.S.C. § 2261A) - If access is part of a pattern of harassment
- International cybercrime laws - Including the Budapest Convention on Cybercrime
Comprehensive Logging & Forensics
ALL unauthorized access attempts are logged with full forensic data, including but not limited to:
- IP addresses (including WebRTC leak detection to capture real IPs behind VPNs/Tor)
- Browser fingerprints and device signatures
- GPU and hardware identifiers
- Timezone and geolocation data
- Behavioral patterns and session recordings
- Full request/response packet captures
Prohibited Activities
You are expressly prohibited from:
- Attempting to access administrative areas, APIs, or databases without authorization
- Scanning for vulnerabilities, open ports, or security weaknesses
- Attempting SQL injection, XSS, CSRF, or any other attack vectors
- Using automated tools to scrape, crawl, or harvest data beyond normal use
- Attempting to circumvent security measures, rate limits, or access controls
- Using Tor, VPNs, or proxies to mask your identity while accessing the site (legitimate users don't need to hide)
- Creating multiple accounts or using fake identities
- Accessing honeypot files or directories (these exist solely to detect malicious actors)
Enforcement & Legal Action
Violators WILL be prosecuted to the fullest extent of the law. Upon detection of unauthorized access, we will:
- Immediately and permanently ban all associated fingerprints, IPs, and accounts
- Preserve all forensic evidence for law enforcement
- Report the incident to the FBI Internet Crime Complaint Center (IC3)
- File complaints with relevant hosting providers and ISPs
- Pursue civil litigation for damages, including attorney's fees
- Seek criminal prosecution under applicable federal and state laws
This policy applies regardless of whether actual damage occurred. The mere attempt to gain unauthorized access is itself a crime under the CFAA.
9. Limitation of Liability
IN NO EVENT SHALL LOCAL WEBSITE PRO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Services
- Any conduct or content of any third party on the Services
- Any content obtained from the Services
- Unauthorized access, use, or alteration of your transmissions or content
Our total liability shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.
10. Termination
By Client
You may terminate monthly services at any time with 30 days written notice. No refunds will be provided for prepaid periods.
By Company
We may terminate or suspend your access immediately, without prior notice, for:
- Breach of these Terms
- Non-payment of fees
- Illegal or fraudulent activity
- Conduct harmful to other clients or our business
Post-Termination
Upon termination of managed hosting services, you will have 30 days to migrate your website and data. After 30 days, all data may be deleted. Code ownership remains with the client for fully paid projects.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Kansas City, Missouri.
